| Annotation | The article deals with the criminal procedure issue of concern as to the determination of evidence. The issue is current due to the necessity of determination of the key category of law of evidence in the context of subsequent reform of criminal procedure of Ukraine. The author studies the concept «evidence», its origin and place in the structure of criminal procedure of Ukraine. The author comes to the conclusion that there cannot be two types of evidence in one procedure: evidence of preliminary investigation and judicial evidence. The contemporary criminal procedure is certain to deal with judicial evidence only. |
