Annotation The article deals with gnosiological, logical and psychological nature of possible and probable knowledge formation in criminal proceedings. The author argues that it is not always false or true. Formation of probable knowledge is subject to objective and subjective factors. It does not exclude the influence of random factors questioning the truth of the knowledge gained on cognitive activity. In order to minimize the subjective factor the necessity to activate the results of proof in criminal proceedings is reasoned.
