| Annotation | The development of the Institution of Witnesses in the criminal proceedings is considered in the article. The attention is focused on the fact that the new Criminal Procedure Code of Ukraine provides it with the rights of the participants in a criminal case. The attention is also paid to the fact that the witness is referred as a participant in a criminal case but this person isn’t mentioned in the independent chapter of the Criminal Procedure Code that contains the norms concerning the others participants in a criminal case. The reasons and the conditions for engaging the witness for the investigative (search) actions are highlighted. The proposals for changes in this institute are proved. |
