Annotation | The article under consideration examines the main theoretical and legal grounds for division of entrepreneurial activity into the types of public relations, which have a private-law and public law nature. It is defined that entrepreneurial activity has significant social meaning that causes the need of its public regulation. The author underlines that entrepreneurship is the sphere of social relations, where all subjects have equal legal abilities and legal obligations; that is why relations between them should be regulated by dispositive method, which is the feature of private law. The main areas of imperative regulation of entrepreneurial activity are the fiscal relations aimed at ensuring of state activity and resolution of social problems, as well as anti-trust relationships directed at assurance of free competitive market environment. |
