Annotation | The methodological value of concept, content and structures of modern criminal procedure for development of criminal procedure theory and practice is grounded in the article. The criminal procedure, being an integral social and legal formation, is proved tom be rich in content and consists of separate relatively independent structural elements which exist in certain interrelation and interdependence. Based on general scientific principles of activity, and results of scientific analysis of standpoints expressed by scientists and practitioners of the Criminal Procedure Code of Ukraine, the author distinguishes such internal structural elements of criminal procedure as object, purpose, tasks, facilities, subjects and result, which turn them into an integral system, as well as its external elements like stages, organizational and legal forms (types of productions). By virtue of defining structural elements of a criminal procedure as well as their content the author draws a conclusion that On the basis of determination of structural elements of criminal procedure in its activity is a well-regulated law activity of court, sides and other participants of criminal procedure, which is carried out in form legal relations directed on achievement of its goals and task resolution. |
