Annotation | The idea of classification of proofs and evidence into pre-trial and forensic ones was declared in Ukrainian science of criminal procedure at the end of 80s of the previous century. However, under the domination of the Soviet doctrine of law, it had not received definite theoretical and legislative form. An important step in delineation of evidence into pre- trial and trial ones was made in a new Criminal Procedure Code of Ukraine. In this regard, the article substantiates their functional purpose. Hence, it provides for various procedural forms of proof for the needs of pre-trial investigation and the organization of proof in the court under the proper court procedure. |
