| Annotation | The article explains the necessity to remove the restrictions of the right of the person to appeal against decision of a court of first instance in a cassation order, with the condition of their prior review in the appeal order from the Criminal Procedure Code of Ukraine (Article 424) based on the standpoint of implementation of the tasks of the criminal proceedings to protect the rights, freedoms and legal interests of the participants in criminal proceedings and in order to protect the individuals, society and the state from criminal offenses (Article 2, Criminal Procedure Code). The author explains the necessity of implementing the responsibilities of the investigator, prosecutor, court to establish the causes and conditions which contribute the commission of the criminal offenses into Criminal Procedure Code of Ukraine, as well as the adoption of measures for their removal by making the submission of separate decision. |
