| Annotation |
The article deals with issues of reforming writ civil proceedings in Ukraine considering the European experience in judicial procedure regulation of indisputable claims. The simplified civil procedure stipulated by the Code of Civil Procedure of Ukraine of 2004 for specific categories of civil cases is analyzed. The legal nature of writ proceedings as a simplified mechanism to decide indisputable claims is studied. The current European order of indisputable claims revision — European order for payment procedure is analyzed. Given the above analysis the ways of national civil justice system reform are proposed. Namely, given the European ambitions of Ukraine the ways of convergence of national and European justice systems in indisputable claims are identified. |
