| Annotation | The author considers the issues of legal process and pays attention the fact that, besides sphere of law-making and sphere of enforcement of the right, there also exists one more procedural fragment, which is not a moment of solely creating the law or a moment of solely implementing it. This fragment consists of two moments — a theoretical moment (as in case of law-making sphere) and a practical one (as in case of sphere of implementing the law). In its theoretical constituent, this stage of legal process «is superposed» on legislative process and its practical constituent represents an independent fragment of state administration, which does not coincide with implementing the law, but it acts as a necessary condition of it. |
