| Annotation | The article suggests the analysis of the legal notion and features of civilistic construction of the novation of debt into the loan obligation. The definition of agreements on novation of debt is determined by the author, as well as inherent features of law terminating liabilities. The legal relations of novation of debt are proved to occupy a special place in the system of loan liabilities and differ from the contractual relationship of a loan. Agreements on novation of debt are considered to be consensual, unilateral, retaliation or gratuitous based on the legal nature. |
