Article Interaction of International Treaty and Custom in the Doctrine of the Anglo-Saxon Legal System

Annotation The article studies specific interaction of an international law of treaties and customary international law. The attention is paid to the study and research of these interrelations in the legal system of Anglo-Saxon countries. Given the analysis of case law of the above countries, applying customary international law and international law of treaties is analyzed in making decisions by courts in the Anglo-Saxon legal family. The issue of the key role of court decisions in further development of the doctrine of international law is studied. The advantages and limits of applying the rules and norms of treaties, with the references thereto in decisions of international courts; the issue of slow development of the role of international customary law and absolute priority of international treaties in regulating interstate relations are studied.
