| Annotation |
The article is devoted to the problems of rail land use under the conditions of servitude and superficies. It is determined that the current land legislation does not provide the transfer of state railways land to the private ownership. It is shown that Ukraine's legislation allows the transfer of railway land for use by citizens and corporate bodies under servitude and superficies. However, it contains many restrictions that are extremely difficult deployment of servitude and superficies for the regulation of the use of railway land by outsiders. |
