Annotation | The article is devoted to the analysis of the sociology of private international law, as well as basic concepts of this new branch of the sociology of law. The author analyzes methodology of the sociology of private international law and identifies basic issues facing this sociology. According to the author, if theory of private international law considers such phenomenon as conflict of laws in a somewhat abstract way, sociology of private international law sees in it expression of complex social reality. From the perspective of the sociology of private international law the meaning and essence of conflict of laws is, to a considerable extent, determined by the peculiarities of those social phenomena which come into conflict, in particular, by their cultural-legal specifics, their cultural affinity and development in them of legal culture and legal consciousness. The author offers to consider basic problems of the sociology of private international law in the context of the dominant currents of sociology (functionalism, theory of conflict, utilitarian theories, interactionism). |
