| Annotation | Article is focused on the historical and legal analysis of the right for compulsory share of inheritance heirs according to the civil law of the Ukrainian SSR in 1919 and 1991. In a scientific article explores the theoretical basis and practical application of legislation which governs the right to a compulsory share of inheritance of the above period. The author defines the concepts of «necessary heir», «right to a compulsory share of inheritances It is reveals how to obtain a certificate of inheritance by law according to the norms of Soviet civil law. F list of conditions under which the right for compulsory share is given to Soviet citizens. A list of property that could be inherited is also specified. Based on the study, the author of the article suggests their own conclusions and judgments about the development of the right to a compulsory share of inheritance of the Soviet period. The author provides a comparative analysis of the legislation, which makes it possible to trace the history of the formation and consolidation of the necessary rights of heirs in the future. |
