Annotation | In this article, based on a retrospective view, the stages of the constitutional process and constitutional reform in the period of independence of Ukraine are explored. The author reveals peculiar features and specifics of each stage, the impact on his political and legal factors, national experience of the genesis of constitutional theory and its application in formation of the constitutional provisions. The constitutional process of modern Ukraine has two distinct periods: before the adoption of the Constitution of Ukraine as an independent state in 1996 and after the adoption of the Fundamental Law. The last one is characterized by the existence of the crisis at different stages in the implementation of the constitutional provisions and working out proposals for improving the Constitution of Ukraine. The main attention is paid to the methodology of contemporary modernization of the Fundamental Law, from 2014 onwards, new conceptual proposals for the improvement of its provisions in the context of a democratic and legal state. |
