| Annotation |
The article deals with consideration of the nature of constitution and possibility to elaborate its variant which is optimal for state and society. The author provides analysis of domestic experience and practice of preparation of the Constitution of Ukraine from 28 June 1996 and contemporary constitutional process. Special attention is paid to realization of provisions of the current Fundamental Law, reasons of nihilistic attitude to its principles and norms. The emphasis is put on fact that while projecting constitutional acts it is necessary to take into account complex action of social, economical, demographical and other factors. The author proved appropriateness of joining provisions on judicial power in the same chapter of the Fundamental Law. It will promote strengthening of integrated constitutional and legal status of judicial corps, etc. Achievements of the Constitutional Assembly concerning reformation of current Constitution of Ukraine and their application in contemporary constitutional process are timely.
