Annotation | Specific characteristics of special pre-trial investigation under the Code of Criminal Procedure of Ukraine and the principle of inviolability of private life of citizens while searching dwelling or other property of a person as a search (investigation) action are studied in the article. The authors study problematic issues and draw attention to gaps in determining the membership of this type of search to ensure rights and freedoms of a suspect absent during a special pre-trial investigation. Given the analysis of the Code of Criminal Procedure of Ukraine, the proposals for legislative regulation of alternative participation of an advocate of the suspect while searching in a special pre-trial investigation and mandatory invitation for persons whose rights and legitimate interests may be limited or violated are made. |
