Annotation | The essence of judgments of the European Court of Human Rights is analyzed. Given the findings thereof, as well as with a view to the provisions of the Law of Ukraine «On the High Council of Justice», the High Council of Justice may be considered a «court» in substantive meaning of the term. In particular, solving the issue of disciplinary responsibility of judges and delivering binding decision the High Council of Justice serves as a court. Moreover, the author introduces possible legislative amendments to the powers of the High Council of Justice aimed at improving functioning there of and bringing basic principles of its activities in compliance with international law. |
