Article Improvement of Democratic Institutions in the Context of Reforming Section I of the Constitution of Ukraine

Annotation

The article is devoted to strengthening of democratic institutions in the process of constitutional reform in Ukraine. Particular attention is given to topics of current conceptual renewal of the Section I of the Constitution of Ukraine. It is concluded that reforming Section I of the Basic Law should be directed at solving the following problems: 1) concentration of regulations of the Constitution therein - the rules and principles which by their content define the bases of constitutional order of Ukraine and are integrally connected to all components of the Constitution as of a document, without which the practice of application of the Basic Law is impossible (difficult), 2) adjustment (specification) of a number of provisions which are determined by the constitutional order in the following areas: a) coordination mechanisms of democracy and the rule of law, and increasing of their effectiveness, b) improvement of the interaction mechanism of national and international law and orders, and c) clarify the constitutional role of political parties, establishing requirements for them, guarantee the rights of opposition, and d) give priority to the provisions of Section I in the system of the Constitution of Ukraine.
