The article is devoted to topical issues of determination of the jurisdictional affiliation of litigation arising from tax legal relations. The analysis of the arguments concerning the advisability of such disputes in order of commercial and administrative litigation is made. This article contains unambiguous conclusions about the public nature of tax disputes, and therefore, the validity of the administrative litigation for such cases according to the law.
