In this article the legal capacity is considered as a precondition for the emergence of subjective civil rights and obligations. The views of scientists were analyzed regarding balance of legal capacity and subjective civil right in regard to children. Also in this article substantiates the proposal concerning of ability to have some civil rights and obligations in accordance with the level of mental maturity of the child.
