The article is a research of a tax offence legal nature as a ground for financial and legal liability. Analyzing the definition of a tax offence in the legislation in force the author suggests the ways to improve provisions of article 109 in the Tax Code of Ukraine taking into account achievements of the financial and legal studies and law application.
