| Annotation | In terms of the general concept of responsibility the author proves the expediency of fixing the constitutional and legal responsibility in the legislation, including vicarious and subsidiary responsibility, in the administration of the electoral process. «Taking over» competence in the system of public power is essential in the author’s concept of vicarious and subsidiary responsibility. That is why the higher election commission shall take a decision on the merits of the matters referred to the competence of the lower level commission. Vicarious and subsidiary responsibility in the system of election commissions is only partially implemented in the current legislation of Ukraine. For guaranteeing voting rights the concept of technical electoral commissions is also suggested. |
