| Annotation |
The article deals with the peculiarities of illegality as a condition for compensation of damages, caused by the state bodies, their officials and employees. The author pays attention to the fact that the obligation of the state is to compensate the damages which may arise even if the actions of the state bodies, officials and employees are not illegal. Basing upon scientific researches and the analysis of the court practice, the author comes to the conclusion that the compensation of damages caused by the state bodies, their officials and employees is usually followed by «twofold» illegality: civil one and administrative one. |
