| Annotation |
The article is devoted to the legal problems in the realization of the intellectual property right owned by several persons jointly. The peculiarities of the contract method of its exercising have been investigated; subject and content of the contract on the procedure of the intellectual property right exercising owned by several persons jointly are determined. The procedure for joint realization of the rights in the absence of the contractual relations between subjects was covered by the author. The problem of the invalidity of the contract for the transfer of intellectual property rights, concluded by one of the owners without the consent of the others has been considered. The nature and legal consequences of distribution of the intellectual property rights have been characterized. The article contains proposals regarding these relations regulation in the Civil Code of Ukraine and practical recommendations on the conclusion of appropriate contracts. |
