Article International custom in the context of international law making according to national and foreign legal doctrine

Annotation The article presents an analysis of the formation of international custom through the lens of the consideration of its basic components and their features. Reference is given to the teachings of the titans of international law, such as: I. Lukashuk, I. Brownlie, A. Cassese, M. Shaw, K. Tomuschet, S. Rosen and others. The author identifies problems of doctrinal approach to the structure of international custom, which traditionally includes general practice and opinio juris, and considers an alternative model proposed by the Italian doctrine, which apart from opinio juris mentions opinio necessitatis. Also, the author analyzes peculiarities of international custom at the modern stage of development of international law.
