Анотація

Сьогодні позитивні зобов’язання держави становлять невід’ємну частину міжнародного, передусім європейського права прав людини та входять до усталеного категоріального апарату західної юриспруденції, однак лишаються малодослідженими в українській науці. Водночас ця конструкція поступово, але впевнено входить до національного законодавства та судової практики України, зокрема й конституційної юриспруденції. Це вимагає комплексного осмислення позитивних зобов’язань як концептуального підґрунтя юридичної оцінки ефективності державної політики у сфері прав людини.

Мета статті полягає у визначенні основних елементів доктрини позитивних зобо в’язань держави, розкритті розуміння та особливої природи таких зобов’язань, окресленні змісту, обсягу та меж, виокремленні типів позитивних обов’язків, що консолідують розмаїття, а також їх структури порівняно з негативними зобов’язаннями та у взаємодії з іншими доктринальними підходами, що утвердилися завдяки “праву Конвенції про захист прав людини і основоположних свобод” (Конвенція).

Встановлено, що еволюція позитивних зобов’язань за Конвенцією органічно вписується у більш широкий контекст еволюції в галузі прав людини, відбиваючи загальні тенденції руху від виключно негативних зобов’язань до “багатовимірних прав”, що містять як негативні, так і позитивні вимоги. Обґрунтовано розуміння позитивних зобов’язань держави у сфері прав людини як таких, що становлять юридично обов’язкові вимоги до держави в особі її законодавчих, виконавчих і судо вих органів запроваджувати та застосовувати ефективні заходи матеріального та процесуального, а також юридичного й фактичного характеру, для запобігання порушенням всього спектру прав людини з боку представників влади або приватних осіб, а також їх захисту та сприяння реалізації.

З урахуванням стандартів позитивних зобов’язань, вироблених Європейським судом з прав людини (ЄСПЛ), доведено, що принципи ефективності та динамічної інтерпретації є підставою для розвитку позитивних зобов’язань. Зі свого боку принципи історичної інтерпретації та систематичного тлумачення норм Конвенції та формулювань її конкретних положень, а також ідея “єдиного європейського стандарту”, заснованого на консенсусі держав-членів, розумно обмежують судовий активізм. Такі обов’язки не можна тлумачити у спосіб, який покладав би на органи державної влади неможливий або непропорційний тягар. Маючи диз’юнктивну (альтернативну) структуру, позитивні зобов’язання передбачають особливо широку свободу розсуду держави стосовно вибору засобів. При цьому вжиті заходи мають бути розумними (обґрунтованими), належними та достатніми, і підлягати оцінці ЄСПЛ із застосуванням принципу пропорційності та справедливого балансу інтересів.

Принцип субсидіарності та свобода розсуду держави обумовлюють покладання основної відповідальності за розвиток позитивних зобов’язань на національні орга ни влади, які, з урахуванням пріоритетів та ресурсів держави, мають забезпечити ухвалення належного законодавства (“національної правової рамки”) та запровадження ефективних засобів національного захисту, необхідних для забезпечення реальної свободи й автономії особи.
