| Annotation | This article presents the research results of certain normatively defined grounds for disciplinary liability of representatives of the judicial branch in Ukraine. The peculiarities of legal status of the High Council of Justice, its bodies authorized to carry out disciplinary proceedings against a judge are considered. The content of some practical aspects of a procedure for appealing against decisions reached by the independent body of judicial governance about bringing a judge to disciplinary liability has been clarified on the basis of analysis of relevant judicial practice of the Grand Chamber of the Supreme Court. The conclusions are drawn about the importance of: 1) legislative consolidation of a comprehensive list of grounds for judge’s disciplinary liability in order to comply with constitutional principles of judicial proceedings and ensure a prompt, complete and impartial trial; 2) forming consistent practice of the permanent collegial body of the highest court in the judicial system of Ukraine in resolving cases related to appealing against decisions rendered by the High Council of Justice, its Disciplinary Chambers, on bringing a judge to the abovementioned type of liability. |
