The conflict theory being developed as a part of a science of sociology can explain in essential the phenomena of law and it's peculiarities as a form of social control, the author believes. He analyses the phenomenon of conflict, it's distinctive features, constructive and destructive conflict's effects, phenomena of confliction and conflictogenity, the forms of conflict's resolution and prevention, and he accents on destructive effect as a risk factor of insecurity in human society. The author interprets the conflict and confliction as a conditio sine qua non of genesis and functioning of law and interprets the nature of law as a mechanism of conflict's resolving and prevention and a factor of dangerous confliction's control. |
