This article highlights legislative novels of implementation by the Prosecutor’s Office of Ukraine function of representation of interests in court with respect to a certainty of object on which implementation of this function is directed. Analyzed the scientific debates on the point and the problematic aspects of its legal regulation. Proposed transition from the concept of representation by the Prosecutor’s Office of Ukraine of interests of particular subject to the concept, according to which the Prosecutor’s Office would ensure a representation of balanced common public interest of different subjects as complex object of implementation this function.
