| Annotation |
The article deals with study and analysis of the issue of arbitration proceedings. The current state of legislation on courts of arbitration and international commercial arbitration is analyzed. The main issues of application of the legislation in judicial practice and realization of the principle of binding arbitration agreement are summarized. The issues of interaction of courts, international commercial arbitration and domestic courts of arbitration at the stage of appeal and enforcement of the awards of courts of arbitration are studied. The areas of improvement of national legislation due to modern trends and international standards of arbitration proceedings are determined. The main spheres of reform of the arbitration legislation are considered. The necessity of preserving dualism in the legal regulation of activities of domestic courts of arbitration and international commercial arbitration is substantiated. |
